Tellabs Product-Specific Terms and Conditions

Unless otherwise agreed in writing, the following terms and conditions, in addition to Tellabs Standard Terms and Conditions, available at Tellabs Legal Policies or upon request (collectively, the "Agreement") shall apply to the purchase, sale and licensing of applicable Tellabs products. Notwithstanding the foregoing, software generally known as "open-source software" is not licensed pursuant to the license grants of the Tellabs Standard Terms and Conditions but is provided solely under its own applicable license terms, in accordance with the licenses set forth below.

The copyright owners of such software disclaim all warranties and conditions, express and implied, including warranties or conditions of title and non-infringement, and implied warranties or conditions of merchantability and fitness for a particular purpose; and all liability for damages, including direct, indirect, special, incidental and consequential damages, such as lost profits; any provisions which differ are offered by Tellabs alone and not by the copyright owners.

If Buyer is the U.S. Government, Buyer shall mark all copies and versions of the Software with:

"RESTRICTED RIGHTS LEGEND:  Use, duplication, or Disclosure by the Government is subject to restrictions as set forth in the Rights in Technical Data and Computer Software Clause at DFARS 252.227.7013."
